Terms of ServiceEffective Date: May 21, 2025 These Terms of Service (“Terms”) govern your use of web hosting, email, backup, migration, design, and related services provided by MagicAngelHosting.com (“Company,” “we,” “us,” or “our”). By signing up or continuing to use any of our services, you agree to these Terms.
1. Account SetupActivation: Accounts are provisioned once payment clears and our fraud screening (or that of our payment partner) is complete. Contact Email: You must supply a valid, non-@<your-domain> email address for notifications, password resets, and support.
2. Acceptable Use PolicyAll services must be used lawfully and in good faith. We reserve the right to suspend or terminate any account at our sole discretion if you host or distribute: Copyright-infringing content, warez, pirated software Hate speech, threats, obscenity, or pornography IRC bots, spam-sending scripts, or mass-mailing applications Malware, hack tools, or DDoS utilities Any content or activity we reasonably deem illegal or abusive
3. Support Services3.1 Standard Support (Included)No additional agreement or fees—covered by your hosting plan: DNS record changes Initial email account creation and basic troubleshooting cPanel/Plesk password resets, PHP version changes (within same major branch) Automated daily/weekly site backups and on-demand downloads Automated WordPress core, plugin & theme updates (conflict resolution not guaranteed) SpamAssassin configuration, whitelist/blacklist management SSL certificate installation & renewal (Let’s Encrypt) Basic database checks, exports/imports
3.2 Extended Support (ESA Required)Available only under a separate Extended Support Agreement and billed at agreed rates: Remote-access assistance (RDP/SSH into servers or client PCs) Advanced mail setup without remote access (Outlook, mobile, IMAP/SMTP guides) Website content changes & design updates (HTML/CSS tweaks, menu reorganizations) Off-site DNS & mail routing (Office 365, Google Workspace, custom MX/SPF/DKIM/DMARC) Manual backups & restores (on-demand or emergency data recovery) Security & compliance Hacking cleanup & forensic restores Malware scans/removal, ModSecurity/CSF firewall configuration DDoS mitigation planning Zero-Trust architecture setup PCI-DSS questionnaire support
Migrations & domain transfers Full-site, database, email migrations between hosts Domain moves away from Cloudflare or to new registrars
Performance tuning Caching (Varnish, Redis, Memcached) CDN integration (Cloudflare Pro, AWS CloudFront) Database optimization & query profiling PHP/MySQL major upgrades
Third-party integrations Payment gateways (Stripe, PayPal, WooCommerce extensions) On-site software (POS, booking systems), vendor-supplied form completion

4. Spam & Bulk-Mail PolicyZero tolerance for unsolicited or bulk email. Outbound limits: 250 messages/hour/account; max 25 recipients per message (CC/BCC). “Safe lists” or “double opt-in” do not override this policy. Violations → immediate termination without refund + cleanup fees. Recipients who mark you as spam will be permanently blocked; removal only upon the recipient’s direct, written retraction. You may purchase a dedicated bulk-mail service (e.g. Amazon SES) if you need higher throughput.
5. Payment TermsPrepayment: All services billed in advance, recurring until you cancel. Late payments: Accounts suspended without notice if unpaid on due date. Price changes: We may adjust rates or resource allocations at any time; changes apply at your next billing cycle. Chargebacks: Any customer- or bank-initiated chargeback → immediate termination, no refund.
6. Backups & Data LossYour responsibility: Maintain local copies; we are not liable for data loss. Included backups: Automated via cPanel; customers may download/download at any time. Extended backups: On-demand/manual or longer-term retention available under ESA.
7. Cancellation & Refunds30-day money-back guarantee on shared hosting (excluding domain registration), unless terminated “for cause.” After 30 days: No refunds. Domain fees: Non-refundable.
8. Resource Usage8.1 Shared Hosting Limits (CloudLinux)8.2 InodesSoft limit: 50 000 files/inodes. Accounts abusing rapid file churn or exceeding 50 000 inodes may be flagged, suspended, or removed from backup rotation.
8.3 Prohibited ProcessesDaemons, web spiders/indexers, BitTorrent clients or trackers, gaming servers, unattended background jobs.
9. Bandwidth UsageMonthly allowance per plan. Overages → suspension or upgrade requirement, additional fees, or termination.
10. Web Design & UpdatesIf we are your designer: Content changes, new pages, redesigns—billed at standard rate ($120/hr, 0.5 hr min) unless covered by a separate design retainer. If not: You must authorize us in writing before we touch third-party sites.
11. Reseller Responsibilities
12. Support Fees & TrainingFree support covers server/network issues, spam config, data-center connectivity, and any pre-negotiated services. Computer support (PC/Mac/email client setup, Google accounts, onsite software) billed at $120/hr (1 hr min). Training (how-to calls, remote sessions) likewise billed unless pre-paid.
13. Domain Registration & RenewalWe may renew domains on your behalf; you must pay renewal fees before expiration. Unpaid renewals within 30 days → we reserve the right to keep or resell the domain to recoup costs. Outgoing transfers with outstanding invoices → considered bad faith, may trigger service cancellation or legal action.
14. Third-Party ServicesCosts for AWS, third-party APIs, or other vendor services are billed to you. We may manage these accounts or you may supply your own credentials. - WordPress Plugins license fees are the responsibility of the client. If you are using a software license, you will need to pay for it. We do offer discounts on some plugins through agency licensing. Please ask if you want to join our agency license.
15. Law Enforcement & Privacy
16. Changes to These TermsWe may revise or update these Terms at any time without notice. The version posted on our site (with the effective date) is always the authoritative copy.
17. Reporting Service DisruptionsAll outages or performance issues must be reported via our online ticket system. Failure to do so may delay troubleshooting or resolution.
18. Autoresponder PolicyOnly for personal accounts (not high-volume/service addresses). Minimum interval: 36 hrs (72 hrs recommended). Do not auto-respond to SPAM or high-score messages. Violations → warning, then suspension.
